คณะกรรมการค าจ าง ได กระจายอํานาจการ พิจารณาอัตราค าจ างขั้นต่ําไปยังภูมิภาค โดยได แต งตั้ง คณะอนุกรรมการอัตราค าจ างขั้นต่ํากรุงเทพมหานคร และ คณะอนุกรรมการอัตราค าจ างขั้นต่ําจังหวัด รวม 76 คณะเป นองค กรไตรภาคีเช นเดียวกับคณะกรรมการค าจ าง การพิจารณากําหนดอัตราค าจ างขั้นต่ํา คณะกรรมการค าจ างจะนําข อมูลตามหลักเกณฑ ที่ได กําหนด ในพระราชบัญญัติคุ มครองแรงงาน พ . ศ . 2541 และแก ไข เพิ่มเติม ( ฉบับที่ 3) พ . ศ . 2551 มาพิจารณาประกอบ ข อเท็จจริงเกี่ยวกับอัตราค าจ างที่ลูกจ างได รับอยู โดยเฉพาะ อย างยิ่งดัชนีค าครองชีพ อัตราเงินเฟ อ มาตราฐานการครอง ชีพ ต นทุนการผลิต ราคาของสินค า ความสามารถของธุรกิจ ผลิตภาพแรงงาน ผลิตภัณฑ มวลรวมของประเทศ สภาพทาง เศรษฐกิจและสังคม ซึ่งการพิจารณากําหนดอัตราค าจ างขั้น ต่ําต องไม ต่ํากว า อัตราค าจ างขั้นต่ําพื้นฐานที่คณะกรรมการ ค าจ างกําหนด ถ าไม มีการกําหนดอัตราค าจ างขั้นต่ําในท องที่ ใดถือว าอัตราค าจ างขั้นต่ําพื้นฐานเป นอัตราค าจ างขั้นต่ําของ ท องที่นั้น ป จจุบันจึงมีการแก ไข และประกาศใช ตาม คณะกรรมการค าจ าง เรื่อง อัตราค าจ างขั้นต่ํา ( ฉบับที่ 7 ) ลง วันที่ 10 ตุลาคม 2555 ซึ่งมีผลใช บังคับตั้งแต วันที่ 1 มกราคม 2556 อัตราค าจ างขั้นต่ํา หมายถึง อัตราค าจ างที่ เพียงพอสําหรับแรงงานเพื่อพัฒนาฝ มือ ( แรงงานไร ฝ มือ ) 1 คน ให สามารถดํารงชีพอยู ได ตามสมควรแก สภาพเศรษฐกิจ และสังคมในท องถิ่น The Committee on wage has decentralized its power to regional committee for making decision for minimum wage rate by appointing sub-committee of minimum wage rate for Bangkok and for 76 provinces. This sub-committees consist of the same 3 parties as the Committee on Wage. Consideration for setting up the minimum wage rate: The committee on wage would take into account the criteria specified in the “Labor Protection Act B.E 2541 (1998) ” and the amended version no. 3 in 2008, compliance with the actual wage rate, cost of living index, inflation rate, standard of living, cost of production and price, business performance and labor productivity, as well as economic and social situations. The minimum wage rate would not be below the base minimum rate, set by the wage committee. If there is no minimum wage rate setting up in particular areas it means that base minimum wage rate is the minimum wage rate. Currently, there was an amendment and announcement regarding the minimum wage rates (no. 7 ), dated 10 October, 2012, which was effective since January 1, 2013. Minimum Wage Rates refer to wage rate that is enough for unskilled labor can earn their life according to their local economic and social conditions. 58 สถิติแรงงาน
