การกําหนดอัตราค าจ างขั้นต่ํา เป นอํานาจหน าที่ ของคณะกรรมการค าจ าง ซึ่ง เ ป นองค กร ไ ตรภาคี ตามพร ะ ราชบัญญัติคุ มครอง แรง ง าน พ . ศ . 2541 ซึ่งคณะรัฐมนตรีเป นผู แต งตั้งประกอบด วยปลัดกระทรวง แรงงานเป นประธานกรรมการ ผู แทนฝ ายรัฐบาล 4 คน ผู แทนฝ ายนายจ าง และผู แทนฝ ายลูกจ าง ฝ ายละ 5 คน เป น กรรมการ และข าราชการกระทรวงแรงงานเป นเลขานุการ คณะกรรมการค าจ าง ได กระจายอํานาจการพิจารณา อั ต ร า ค า จ า ง ขั้ น ต่ํ า ไ ป ยั ง ภู มิภ า ค โ ด ย ไ ด แ ต ง ตั้ ง คณะอนุกรรมการอัตราค าจ างขั้นต่ํากรุงเทพมหานคร และ คณะอนุกรรมการอัตราค าจ างขั้นต่ําจังหวัด รวม 76 คณะ เป นองค กรไตรภาคีเช นเดียวกับคณะกรรมการค าจ าง การพิจารณากําหนดอัตราค าจ างขั้นต่ํา คณะกรรมการค าจ างจะนําข อมูลตามหลักเกณฑ ที่ได กําหนด ในพระราชบัญญัติคุ มครองแรงงาน พ.ศ. 2541 และแก ไข เพิ่มเติม (ฉบับที่ 3) พ.ศ. 2551 มาพิจารณาประกอบ ข อเท็จจริงเกี่ยวกับอัตราค าจ างที่ลูกจ างได รับอยู โดยเฉพาะ อย างยิ่งดัชนีค าครองชีพ อัตราเงินเฟ อ มาตรฐาน กา รคร อ ง ชี พ ต น ทุ น ก า ร ผ ลิ ต ร า ค า ข อ ง สิ น ค า ความสามารถของธุรกิจ ผลิตภาพแรงงาน ผลิตภัณฑ มวลรวม ของประเทศ สภาพทางเศรษฐกิจและสังคม ซึ่งการพิจารณา กําหนดอัตราค าจ างขั้นต่ําต องไม ต่ํากว าอัตราค าจ างขั้นต่ํา พื้นฐานที่คณะกรรมการค าจ างกําหนด ถ าไม มีการกําหนด อัตราค าจ างขั้นต่ําในท องที่ใดถือว าอัตราค าจ างขั้นต่ําพื้นฐาน เป นอัตราค าจ างขั้นต่ําของท องที่นั้น ป จจุบันจึงมีการแก ไข และประกาศใช ตามคณะกรรมการค าจ าง เรื่อง อัตราค าจ าง ขั้นต่ํา (ฉบับที่ 11) ลงวันที่ 13 กันยายน 2565 ซึ่งมีผลใช บังคับตั้งแต วันที่ 1 ตุลาคม 2565 The Committee on Wage, which consists of three parties as set forth by the Labour Protection Act B.E 2541 (1998), is authorized to set the rate of minimum wage. The Committee on Wage was set up by the cabinet, chaired by the Permanent Secretary General of Ministry of Labour, together with 4 representatives from the Government, 5 representatives of each of employer and employee sides, as committee while the official of the Ministry of Labour is a secretary of the committee. The Committee on wage has decentralized its power to regional committee for making decision for minimum wage rate by appointing sub- committee of minimum wage rate for Bangkok and for 76 provinces. This sub-committees consist of the same 3 parties as the Committee on Wage. Consideration for setting up the minimum wage rate: The committee on wage would take into account the criteria specified in the “Labour Protection Act B.E 2541 (1998) ” and the amended version no. 3 in 2008, compliance with the actual wage rate, cost of living index, inflation rate, standard of living, cost of production and price, business performance and labor productivity gross domestic product, as well as economic and social situations. The minimum wage rate would not be below the base minimum rate, set by the wage committee. If there is no minimum wage rate setting up in particular areas it means that base minimum wage rate is the minimum wage rate. Currently, there was an amendment and the minimum wage rates (no. 11 ), dated 13 September, 2022, which was effective since October 1, 2022. 58 สถิติแรงงาน
